I have married my wife last friday. we have been living together for almost two years and own a home together for 6 months. I have been in the stats on A2 visa up until now (3.5 years). I have the doctor's letter on hand and I want to apply for my adjustment of status by early next week. I was told that I will ( MUST LIKELY) receive my I-131 travel document approved in no earlier than 3 months from the time of filling. I have bought tickets to go with my wife to New-Zealand for our best friends wedding on november 5th which means I won't have the travel document on hand in time.

What can I do?

Please help me!

I believe finger print needs to be obtained somehow to varify the person. Hope it is not damaged too much. Why dont you try to obtain a doctor's letter stating that she had some blisters and is recovering? Usually for ladies it shouldn't be much of an issue but just as a precaution. The POE officers are usually good towards Indian ladies, particularly when they travel alone. So dont worry too much.

I have a quick question. My I140 got approved in sep'08. Should I have to wait till PD gets current or I can file for I485 and USCIS will process my application according to my PD?

Hi,
I'm in my 7th year of h-1b with approved I-140. planning India trip this summer and will have to go through painful h-1b stamping in Hyderabad.

I work full time for a big firm (10000 employees) and have masters in US.

Would be really helpful if you can share your h-1b stamping experience in recent months. Getting little paranoid reading about increase in 229g these days even after producing all docs.
Also is it fine to travel and get stamping when one is beyond 6 yrs of h-1b with GC underway.

It would be risky.F-1 visa requires strong ties to homeland. Since your parents are already here, it would be difficult for you to prove that you will indeed go back to India on completion of your studies.

Sir/Mam,

I am was in US on H4. I am currently in my home country for vacation.
While here, I got my H1B applied and approved as consular processing for 2011 cap.

I plan to go back to US in August on H4 and then apply COS in October and start working.
My question is : Since my H1 was approved while I was out of US, will my COS also be approved as consular processing only? Do I have to go for stamping again before I could start working???

Also, if I decide to wait and get my H1 stamped in my home country, what is the earliest I can go to stamping for 2011 cap? Can I land in US on H1B sometime mid September and start working from October.

Appreciate your feedbacks.

Online EAD status says Card production ordered. Not received card yet. Is there any memo/ lawyer opinion that says it is OK to work that as a basis for employment eligibility?

You need to have the card in hand to fill in I-9.

I am on H4 visa, based in Georgia. Did anyone get �Change of Maiden Name to Married Name� done on passport from Indian Consulate Houston, TX.
Can anyone tell me what am I supposed to write in the �Surname� column in the new online application form ? The old application had 2 columns, 1 for maiden name and the other for Desired Name, but the new online application form has only 1 Surname column. I am confused as to what should I write � my maiden name or my married name. I do have the notarization done on the affidavit form. Does this give me the right to write my married name ? Which name should I sign in the application- maiden or married name?
AlsoI have heard that anybody submitting �Change of Maiden Name to Married Name� application in person, to Indian Consulate Houston, has to collect the new passport at the counter in person, the passport will not be mailed to him/her. The passport is only sent by mail to those who have sent the documents to Indian Consulate Houston by mail.
Is it true?

I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.

Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.

I am planning a vacation to India in November 2010, what are the options with me when come back to US.

- Do i have to stamp the H1B visa OR

- I can still come back on my existing L1B visa ???

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.

I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.
