Hi,
I am planning to travel to Indian in coming months. However, I have a stright outright dismissed CMIT case back in 2007. I got the non convincted case expunged. I got FBI finger print results and they say no records were found. I got BCI from state which states no records were found. Last time , I travelled abroad was in 2006. I have a valid AP.
Do you see any risk of re entrying US on AP?.
Your help is much appreciated as I have to have to be there in India.

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

I got my 140 approved and my 6 yr H1 gets over in Jan 2010.
Could someone tell me whn is the earliest I can apply for my 3 yr extension??
And is there a time period before you have to apply for the extension?

Hi
I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.
My question is where should I file my AP?. Do I need to file with NSC or TSC?.

I got an LUD on my I140 on 07/28/07. There is no message change though. This I-140 was approved way back in Aug 2006. I have filed my I-485 etc on June 1st 07, and its in process. Does anyone know what doesn this LUD mean.

I have an approved 140 with Sept 2005 PD
I have an I 140 and I 485 filed with Dec 2006. There is an RFE on this. I want to interfile I 485 with the approved I 140. Is there a possibility and if so what needs to be done.
I have submitted the response to the I 140 RFE. May be I will get a response in 2-4 weeks.
However, if the I 140 gets denied can I still Interfile my 485 with ealrier approved 140?
What are the options open for me to keep my 485 alive?

So we got an RFE. Bummer. Some of the things were really simple things, like I missed signing in one spot... oops. Had to get a copy of my dad's birth certificate because he's supporting my husband with his income. But two of the RFEs were for taxes which I am 99% sure that I sent in for 2007 for both my father and I, so I don't know why we got an RFE for that (I just ordered the tax transcripts for all 3 years for the both of us, just to make it easier). Anyway, they also want my dad's paystubs for the last 6 months. Cool. So I went through my dads paystubs, and two of the paystubs are missing from the last 6 months - one from May and one from March

IV Members,
My PERM Labor application was certified on Jan 24th 2011. Attorney received an email that the case has been certified and will send the approval notice shortly.
Its been close to 4 weeks and have not received the hard copy. can someone share their experiences about the time line to receive hard copy.

My lawyer filed my I-140 application in nebraska service center. Is that correct? shouldn't it be Texas Service Center for Florida. Does it matter which service center to apply to?

Can i apply to full time program and if i am admitted, can i apply for change fo status to F1?

Has anyone traveled to India by Virgin Atlantic connecting to Jet Airways at London ?
The ticket is from Virgin Atlantic (through ticket, Jet is their Code Share) .
For baggage rules, Virgin website says --
"Any passengers travelling from India to the USA, (and vice-versa), with Virgin Atlantic for their entire journey, which involves a connecting flight via London Heathrow, will be entitled to an additional bag up to 23kg ."
I sent them an email before ticketing and they replied I am entitled to two piece.
When I contacted them after ticketing , they say I am entitled to one piece. Logic was London - Mumbai is by Jet Airways (but my argument is the ticket shows VS flight number).
Does any one have any experience ?

New/amended 140, if the LC states correct job requirements (assuming the mistake was made on 140 application).
New LC if old LC states incorrect job requirements.
I have a Masters Degree in the US and the 5 yr experience required for the EB2 also the position requires it; however my lawyer made a mistake and asked for an EB3.
I already received my I-140 and my I-485 was filed at the same time.
What can I do to change to EB2?

Both my wife and I are working on H1B visa.
We are landing in Canada for H1B visa renewal.
However, the nvars.com appointment system allows 1 primary applicatnt and then allows to add dependents to that application. Should I add my wife as a dependent or create an independent primary applicant profile for her since she would be requesting an H1 B renewal as well.
If I create an independent primary applicant profile for her, I may not be able to get the same visa date / appointment for both of us.
Please guide.
