The worrying news below talk about findings that the U.S. has lost influence abroad as a result of the Iraq war, thus encouraging detractors such as Russia and Iran...so, this begs the question: Is this really the time for the country to also encourage loss of influence at home, by promoting a massive and catastrophic Reverse Brain Drain? Ask most international students, they don't believe the U.S. is the future and thus they do not plan to remain here after their studies....if that is not "loss of influence at home" I don't know what is

Can labor and I140 be filed from an employer, even if employee is not working for that employer currently, may be with the intention of joining that employer at later date? Please reply.

I have one white I 94 which you get at the port of last entry and three H1 I 94 (one original H1 I 94, two extention I 94s). The latest I 94 goes till 2010. Should I surrender all four I 94s or just the expired ones or just the white one.

yup. you should have completed 180 days I guess after getting 140 approved. There are many threads for this discussion. try to find it.
Its not for the I-140. If you have completed 180 days after applying I-485 & I-140 approved, you can use the AC21. But if you have only I-140, there is no use.

I have a situation here.
I am on H1B visa and just changed my job in September.
My H1B transfer (thru my new company) was approved and according to USCIS website, they have dispatched my 797-Notice of Action. But I am yet to receive those papers.
Now, I was on extension of H1B earlier (thru my old company), as my stamped visa expired.
Now, my spouse needs to visit India urgently. Can she travel to India with her old I-94 (the one that was stapled on the passport when she entered US the last time) and the other I-94 that she has with the visa extension papers ?? Of course, once we get the new Form 797, I shall also travel to India and we both will get our visa stamping done before we travel back to USA. Please suggest...

We got the EAD receipt for both of us.My EAD Status says card ordered but my spouses EAD is still pending. Any one in a similar situation? FP Notices receive for both of us.

AP not yet received. But EADs have been received for me and my husband (primary applicant). However, my daughter is yet to receive her EAD. Anybody with a similar case? I tried calling IO in USCIS but they say that it may come any time within 90 days of the notice date (not the receipt date!):mad:

Hi all,
I had my h1 issued in nov '09 and was laid off from the company in march '10. However, I was able to secure other position in the same company a month later. But now the company wants me to exit/re-enter the country (and get my visa stamped) before starting the new position.
Since I was technically out of status for the month of April (and don't have any paystubs for the same), will it be difficult to get my h1 visa stamped? Also, can I get my stamping done in Canada, or will I have to my home country?

USCIS reports that 1000 H-1Bs were receipted over the past week with 34,500 now counted. 400 masters cap cases were added bringing the total to 13,000 in that category. That's about on pace with the last several weeks and the exhaustion target in that category remains February 2011. My methodology is simple. I have changed from h1 to f1 in 2002, but did not apply through the mail in status change process, just took my I20 and got it stamped in a Consulate outside US (Mexico in my case).
So not sure, how the mail in status change would affect you if you directly show up in a US Consulate. It is probably best to ask a Lawyer.

Hey folks who signed up for advocacy days: I am so proud of you! You signed up for the good of all of us. I heard some of you are not confirming your participation. This cannot be an option at this point!
After all the effort IV has put in in securing the appointments, I, V, We all are counting on you. You had the best intentions when you signed up and we appreciate that, now we need you to finish grad school without being a drop out.
Many hundreds of hours have gone into organizing this event and not having folks at a meeting that has been confirmed is bad PR for IV and disappointing, sad and frustrating for the people who have been working tirelessly. Can't have it, can't tolerate it. You guys must follow through on your commitment!!!!
