I have some questions:
I have EAD and AP, but i never used it. Still working on H1.
My wife used EAD but never went outside US..so never used AP.
1) In EAD form, for Q.15 Current Immigration Status for me and my wife?

Being an Indian does matter in this discussion....in most of ur post ...u r referencing people from ROW...I understand what they would be feeling...that FYI was for u to understand that if I could get offended then people from ROW surely will...
there r lot of people on EB3 ROW who are either nurses, engineers etc...They are well qualified...and u don't have a right to call them unskilled...Period..End the discussion

AC 21 and EAD are two completely disjoint things.
You can invoke AC 21 and switch to a different job and you could either use your EAD to join the new emplyer or even transfer your h1b to the new employer.

Frustrated by the Senate Judiciary Committee's slow progress on politically sensitive immigration legislation, Senate Majority Leader Bill Frist (R-Tenn.) introduced his own bill last night to secure the nation's borders and crack down on illegal immigration.
Frist's bill will go directly to the full Senate. But he said he will allow Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) to substitute a committee bill if Specter's panel could approve one March 27. Otherwise, the majority leader will stick to a strict, two-week schedule to finish work on what he conceded would be "as challenging a bill as any we'll have to address this year."
The majority leader's power move stunned committee Republicans and Democrats, who have been struggling for three weeks to reach agreement on a comprehensive immigration bill. Specter said he objected to the maneuver.
"It would be chaos on the floor to have this bill debated without the committee acting first," Specter said yesterday afternoon, only to grudgingly accept Frist's move in the evening.
Some Republican aides said they believed presidential politics were at work. Frist, a prospective candidate for 2008, left out of his bill the guest-worker program that President Bush has demanded and Sen. John McCain (R-Ariz.) -- a potential White House rival -- has championed. Such a program is unpopular with many conservative voters, who see it as amnesty for illegal immigrants. Many Republicans believe a new law to get tough on illegal immigrants is one of the few pieces of legislation that must be passed before the November elections if the GOP is to maintain the allegiance of conservative voters.
Frist said he was motivated by a belief that only prompt Senate action will allow Senate and House negotiators to reach a compromise on a final bill this year. The House passed in December a border security bill that did not include a guest-worker program.
Senators from both parties have come to near-agreement on provisions bolstering the U.S. border patrol, adding new technologies such as unmanned aerial vehicles and raising penalties on illegal immigrants and those who aid them. Sens. Edward M. Kennedy (D-Mass.) and John Cornyn (R-Tex.) neared agreement yesterday on a guest-worker program that could smooth the way to bipartisan passage of a Judiciary Committee bill when lawmakers return from a week-long break next week.
Under the deal, Kennedy would agree that illegal immigrants who qualify for a guest-worker visa would have to go to their home countries for a year before applying for a visa extension of three or four additional years. But, Senate aides said, that one-year return could be waived if guest workers' employers said their continued labor was necessary or if a guest worker could prove a consistent work history.
With Democrats, Bush and many Republicans favoring a guest-worker program, immigration advocates say no immigration bill can get out of the Senate without one. But House opponents say they have commitments from Republican leaders that no guest-worker program will be considered on the House floor this year.

You can send 2 passport photos along with your other documents.. Since it is the first time, you wont have old AP and no need to send it also (;))

couple of confusing questions regarding AP (I-131) renewal using E-File. As I am using E-File first time, I would appreciate help very much.

1. If you have an advanced degree from the US after the bill is passed
2. If you are smart enough for EB1 self-sponsorship OR can find an employer to sponsor you as Eb1 or Eb2
3. Either way, you need to go through I140.
4. Then you can file for Adjustment of Status, either concurrently, or after the 140.
I am not sure if you will still be subject to the numerical quota, or if you have to go through labor cert..
I think the intent of the provision is that this category of people not be subject to labor certification, but there is no language in the bill that says that.

`(2) STUDENT VISAS- Notwithstanding the requirement under paragraph (1)(C), an alien may file an application for adjustment of status under this section if--
`(A) the alien has been issued a visa or otherwise provided nonimmigrant status under section 101(a)(15)(F)(iv), or would have qualified for such nonimmigrant status if section 101(a)(15)(F)(iv) had been enacted before such alien's graduation;
`(B) the alien has earned an advanced degree in the sciences, technology, engineering, or mathematics;
`(C) the alien is the beneficiary of a petition filed under subparagraph (E) or (F) of section 204(a)(1); and
`(D) a fee of $1,000 is remitted to the Secretary on behalf of the alien.
`(3) LIMITATION- An application for adjustment of status filed under this section may not be approved until an immigrant visa number becomes available.'.
What this really means is a masters student can adjust to immigrant visa status although his visa application will get approved only when the visa is available. If i have understood this correctly this means that this is similar to the S-1932 provision wherein you can adjust your status although approval will happen only when immigrant visa is available.(provided one is masters)

But I agree with Tito to some extent. Especially, if the degree is from even a slightly lower ranked school like Arizona or Northwestern, the returns are not there, and there is a great deal of evidence in that direction.

I dont think this bill has or will have any favorable provisions for us unless a miracle occurs.
I think the tech companies have cut a deal with the Senators through which they will have access to 115,000 H1Bs and more moving forward inlieu of no increase in EB green cards.
Well..if thats the case they seem to have gotten a bad deal cause even togh the H1B visas will increase - there is still the $5000 inc in fee with other restrictions on consulting, removal of dual intent plus the Sanders amendment that deals with layoffs - these conditions nullify whatever the inc in numbers is

This is for the ones who think that the discrimination based on EB3 or Eb2 is a bigger issue! I would not get into the discussion on why I think that IV is not just about EB2. Also, on our forums it's about reality and not empathy, which everyone should understand.
Now having said that, please direct your energy towards elimination of country limits rather than fighting a fight which was in your past. Why your company put you in EB3 and not EB2 is not something USCIS or US can control anyways. But when you are EB2 or EB3 with same qualification, experience and expertise compared to someone from say Europe, Australia and many other countries but China, India, Mexico and Philippines than why should that other person get it before you do when you applied before him???? What is America getting anything different from this other person?
Now talking about diversity for country limits India is more diverse than any other country in the world! And hey, most of them are already here in the country and waiting in queue, how is this helping the diversity?
What is use of that? At the year end all remaining numbers will come back to India and China. This year they got 9000 numbers all the numbers went in EB2 group. There is no advantages for EB3I.
