I also do not understand why H4 are not eligible for work permit. I think when they passed H1b, they did not lobby for H4's to have work permit as they probably did when they introduced L1/L2 and E1/E2 visas. The onus is on us H1b holders to ask for H4's to have work permit. So I hope IV adds this to their list of goals if it is not already one. Lot of people understand that current H1b limit is not enough so this could be a good option if they are reluctant to increase the H1b cap.

Just a quick update I efiled on Sept 22nd 2009. Was assigned to LIN, Nebraska. Sent supporting documents the next day by first class mail. Received 2 copies of advance parole in the mail yesterday. Checked online this morning case was approved on October 2nd 2009. So basically from filing online to approval took 10 days total. I am amazed.

I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.
I did paid 50% travel cost to one of our member from CA.
Sorry for not attending this time, will do it next time.

1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership

Above excuses seem perfectly genuine to me. I had a court hearing myself. I applaud your friend's sincerity in attending the rally and I also applaud everyone who attended for that matter. But, IMHO, you were too quick to judge/question other people's genuineness.

Senator Frist Bill's bill excluded the controversial Temporary Guest Worker Program and Earned Adjustment of Status of Illegal Alien Program. Does it mean it is the end of these programs in the Senate? Nope! Frist's bill would go directly to the full Senate, but reportedly he said he would allow Senate Judiciary Committee Chairman Arlen Specter, R-Pa., to substitute a committee bill if Specter's panel can approve one by March 27. Otherwise, the majority leader will stick to a strict, two-week schedule to finish work on what he conceded would be "as challenging a bill as any we'll have to address this year." Senator Bill Frist certainly has dropped a bombshell, making his colleagues totally stunned, but there is a good chance that the Temporary Guest Worker Program and the Earned Adjustment Program eventually adopted by the Judiciary Committee on Monday, March 27, 2006 and the Committee's final compromise bill put on the center stage on the floor of the Senate.
The good news is that for the gain of politics or not, the comprehensive immigration reform legislation may move fairly in good pace to some observer's surprise. Legal immigration and employment-based immigration reform are clinging on the edge of the politics involving on these two issues.

Every airlines has its onw set of issues - u will get the pinch only when shit hits the fan. My bags were stranded in Dubai and when I reached Chennai I had nothing with me except a small bag with no clothes.
The agents told me - if you have Indian passport then Emirates will give you $$ compensation per day but if you have American passport Emirates will give $$$ per day. They reimbursed me for 2 sets of clothes and shoes and $50 per day for three days because my bags arrived one by one on the third and fourth day after calling them everyday and pressurising them. If we did not call them - the bags would come slower than that. In Dubai the bags were in hot sun and I had choclates inside and somehow the cover broke and choclates melted and seeped through and a I think you all can imagine how it is.
What I am saying is - things are good everywhere unless we get into issues. Things were good until Retrogression hit us here. Now we complain about difference in treatment - but earlier wenever complained.
What I am saying is - when dealing with things outside of your home country - you cannot expect or assume fairness to you.
I would submit that this is far more discriminatory than Air France or any other airline flying via Europe. The European carriers are bogged down by their country's immigration policies, it seems. I flew Air India via Frankfurt once and the German security officials had all Indian passport holders (not possessing a Schengen or transit visa) quarantined in a separate holding area with inadequate seating and restrooms for the hour-and-a-half layover. I can imagine the frustration that would have ensued had there been longer delays.
However, unequal compensation for troubles caused by the airline is entirely a different and unacceptable matter. It is discriminatory and I'm sure it violates some international mandate somewhere.
I disagree that because you are outside your country, you cannot expect to be treated fairly. Unless they have a solid evidence that you have broken a law, they should not treat you any different than any other person.

The bottom line - there are visas available in EB2 ROW and EB1 categories (which are current, meaning, undersubscribed), that are getting redistributed to EB3 ROW. This is why EB3 in total is using more than its share of 140,000 EBs. In fact, I believe the dates will be moving pretty fast on EB3 ROW, it will probably get all current in a couple of years.

I thought only who have advanced degree from US universities in STEM with 3 yrs exp are exempt from quota. That's what the talk all over the media. I am not sure how this is going to be, because 3 years of US experience is not very hard criteria to meet for which some of the votings won't go well. But have to wait and see.

Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)
no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!
so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.

and i see here a comment that every campaign has been bad for EB3 india.
i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

so i understand how the whole 7% thing works now in relation to the total visa's available....
but what i dont get it the fact that EB3 ROW was at Aug 02 in april this year,
then in May it moved to AUG 03, so people were clearly getting through the system....
then in June it moved to June 05 so again in that month people where getting processed, and moving through the system....
then the July fiaco, i guess because they were running tight for visa numbers...ok water under the bridge.....
But now the Oct bullitin which is the start of the new fiscal year puts us back to AUG 02 again........how does that work??? i dont get it. how can they suddenly be dealing with people from 02 when even in May it was up to AUG 03???
I would have thought that with the start of a new fisacl year there would be a full fresh batch of numbers, and people would get through a bit quicker for a least a couple of months...you would have thought that it would be current for the first month on the new allotment....wouldnt you???

I would have thought that with the start of a new fisacl year there would be a full fresh batch of numbers, and people would get through a bit quicker for a least a couple of months...you would have thought that it would be current for the first month on the new allotment....wouldnt you???

Does anybody knows when this bill is going to be discussed in the House?
:) No one seems to have any concrete info. There is lot of empty talk and idle speculation by some of the forum members, though. Guess that's what the public forums are for :D

I wouldn't make that decision until Oct of 2008.
My personal opinion and analysis tell me that EB2 will soon get retrogressed from what it is today and the picture will not be that rosy in a couple of months.
I would wait until Oct 2008 and see what kind of visa numbers are available at that time for EB2 and EB3 and them make any decision on switching.
Again..just my opinion.
