Again, the bulletin mentioned beginning July 2. Every day, any day, starts at 12:01 AM. July 2 is no exception.
I Feel that what USCIS will do next is not return any application back to sender but DUMP them in some backlog storage room like BEC center and people hAVE TO WAIT FOR NEXT YEAR VB in OCTOBER IN ORDER TO GET RECEIPT NUMBER BASED ON PD AND THEN THEY WILL GET EAD and AP. The only thing is one might save on INCREASE 485 FEES:eek:

I got to know from my attorney that, USCIS has my I 140 information in their system and they gave him a receipt number. But, the receipt is not generated yet. It may take a week or so to get the receipt. My appl was filed on 12th and it reached NSC on 13th.
I checked the status online with this receipt # and online status shows that they recieved the aplication on 19th and its at Texas center. May be my appl was moved to Texas now.
wat information does the lawyer/employer needs to give to USCIS to get the receipt number ?

My case was similar as yours. USCIS just sent a Denial on my 485 without sending a NOID in May. If 180 days have been passed on your 140 approval, then you are safe. If your employer revoked your 140 within 180 days, then you have a problem. Normally desi employers revoke 140 because of Ability to Pay issue etc. especially when you move to a different company. Good thing is that you still have your H-1 to fall back on.
Anyways, My case was reopened within 2-3 weeks after we filed MTR and got a copy of the decision. Filed EAD and AP renewal this July.Got EAD and turns out they denied my AP based on the previous 485 denial in May and didnt even look that they have reopened my case in June. So fighting with USCIS Nebraska center on that right now ! Too infopass and the Immigration Officer is supposed get the information corrected on my file and get my file reopened for AP. Really dont think they look into their own notes or paper work even when issuing denials.

Hi, we recently applied for COS to H-1B at California Service Center on May 26th under premium processing. So far we have not received even the receipt notice, neither have the checks been cashed. Just wanted to check with everyone if this is normal, or did they misplace the petition?

They did it for their country and fellowmen to be free from the clutches of oppression (a much serious issue than green card i think). Although even that is extended selfishness (cos of being Indian or African American) but they dedicated their entire lives for that cause.

Historically, 5 years for end-to-end GC process is not considered as catastrophic delay...
There is a good chance that 2005 PD might get approved in 2010 summer , even with current system unless USCIS looses more visa #s. So IV and all of us have to scream at high pitch and frequently so that no more Visa #s are lost. I think it is happening
2003 this summer , 2004 in 09 and 2005 in 2010 is quite possible.
Now if we all contribute more $$$ to IV we can expedite the above time table.
data indicates some movement in approvals for EB3-I in last 3 weeks. sorry IV , unless sorting issue is fixed, rich data is not of much use . Example: sort by PD's does string sorting instead of date sorting .

Yes if you are born in India, then US skilled immigration is closed for EB2/3...its over..finished. I realized this in 2005 itself and started preparing, applied for Canada
PR in 2006. Took GMAT and applied for MBA. I only applied for Canadian schools...not 1 US school...I learnt my lesson...fool me twice shame on me. In 2007, I got my Canada PR
and well my MBA admission. I paid resident tuition fees, got loans from Banks as I was a PR. The plan worked picture perfect.
Interestingly when I was applying for my MBA in Canada, one friend of mine was preaching to me to do in US and not Canada....well guess what ...he got his a** handed over to him and lost his job and is back in India. He applied to US top schools and thankfully he didnt get admission. Overwise I dont know what would have happened.
I am in touch with Indian student in US B-schools like Harvard as well. Their life is living hell now with 20+ lakh loans in India with parent's home as collateral. Employers run away like seeing ghosts moment you mention H1B.

I think that the best way to get media attention is to have own journalist.
It would be possible to have an Immigration Voice Daily (or Times). However I am to sure how difficult would be to have some one participating in presidential campaign debates and rallies as well press conferences and ask questions about legal immigration.

The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!
Yeah much of what you said is true, however when you keep harping on the words "equal" and "evenly" You are wrong. Evenly or equally implies each applicant has an equal shot at getting through in a certain period of time. That's my only beef with what you are saying.
Once again however, let me state to you that the intent of US EB immigration law is not to be fair to you or me, it is to do what is best for the employer's skilled labor shortage.(Except in a few self petition cases recognized as in the national interest.)

In 2001 when I travelled to India, I paid 1200 to fly NWA. I paid 1000$ in 2008 on Asiana. Very good service. Although airline costs have increased, price of tickets havent increased proportionally.

Let�s say I receive my Green Card in couple of months .now my situation. Right now I am on EAD, Single and EB2 current. And I am planning to go to India to get marry ( if I find any girl but you know how its goes) . but my Green card is coming before may wedding so I can not add my wife in 485 ��now I can try F1 but lets say she got rejected and also she is not able to get H1B ( and you know F1 is not sure VISA) �.so what are my options to bring her in USA .
One option I can sponsor her on family base but it will take 5 years to bring her in US. so I want guidance in this I am sure there are lot of people like me .

it's very easy to make assumptions of how the system works in this country when people want a solution that fits their own particular needs.
When people have been part of this society for less then 10 years; it is a very, very short time to understand how the system works and the whole history and what goes on behind the scenes.
Irrelevant and probably true for you as well. You don't need to be part of a society to understand how it works. You can understand it just fine by reading the literature produced by that society.
I've said this in the past; many people walk around with eyes wide shut. Do some really exhaustive work of the history of immigration; the debates that happened when the laws got created; what has passed, what hasn't; what uscis/ice/dol is doing; request for evidence, denials, consulate refusals; underbidding of contracts, etc.; you may come up with different conclusions then what you may currently believe.
It's tempting but also very naive to lay the blame for immigration restriction via the country quotas on abuse. My views on this were shaped after reading the history on immigration to the US and the literature put out by the anti-immigration movement.

I had been there in US for 7 yrs (3 yrs in L2->1yr out of US->4 Yrs in H1B). Saw the myths and tragedy of US GC process very closely. Didn't want to spoil peace of life and my hard earned money with USCIS and lawyers:mad:. Didn’t look at the US GC application and applied for Canadian PR. Came to Canada with PR last year from US. Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE…. enough…. I am not going back to US even for a visit in next 5 yrs..…
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D
