Thing is they not always predictable. My spose EAD was approved in June. The aprroved the EAD starts after the current one ends in Oct. I dont know how they were trained to handle this.
And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

I posted a reply long ago - it was quite hard-hitting on Berry. It somehow hasn't shown up until now - wonder if the editors "balance" the pro- and anti- immigrant letters :mad:
BTW this Berry guy seems to be in the know of everything happening on this site. I hope at least now those blowhards among us who insist of by-the-minute updates and "where is my 20$" questions appreciate why the core members don't give updates on these forums. The problem of contacting media with "stories" is that you don't want people who are just hanging by a thread; just trying to stay in status and having all sorts of hardship because they want to stay. It feeds into the fact that there are a lot of people here which the country doesn't need. Discussing layoffs or threats of layoffs or employer abusing, etc., feeds into the perception from an outside person that there are too many people here not doing specialized work that an American is not able to do.
Regarding Berry. I haven't gone to programmersguild web-site in a long time but the point that they seem to always bring up which seems to really bother them is that an American lost their job after training an h-1b person who was a cheaper option or an American lost their job because they had to train an L-1 worker who would then take the job offshore. He also points to h-1b companies who don't pay very much (information taken from LCA's which is public information).

Everyday there is a merger and job elimintions where one person has to train another who is getting their job cut. If a person is overpaid for a job that doesn't require much experience then they are pretty much dead weight and are discarded. This is not specific to immigrants but has been going on for many, many years in this country. Therefore, although their arguments at face value may have some merit to them; the business leaders, members of congress/senate are too smart because they themselves have done this at companies they may have been associated with and those companies probably didn't have much immigrants working there.
Unfortunately, on paper it does look like the bodyshops are paying very low when looking at LCA's. However, we all know that what is listed on the LCA; in no way has any reality to the total compensation that a person is getting paid. If people are working on ratio which most people do convert to; their billing rate on the low end would be $50 ($100,000 per year) which would probably work out to $80,000. However, the LCA might only show a salary of $50K (people take per diems as the rest or save it for a rainy day).

OP was never out of status as he was working for one of the employers on proper work authorization all the time. The only question is whether employer X canceled H1 ?Even if they didn't, it is employer's problem not OP's.

Once i called USCIS for my AP using BUNNYBOY sequence. The USCIS officer was rude and asked me who is the attroney. When i mentioned fdbl then he mentioned that fdbl is a respected within fdbl.
They take the process long but their success rate is 99.99%

Hi guys, I really need your advice on this :
1)Working for a large financial consulting firm A now, in-house lawyers dealt with the H-1B, renewing it now for Oct this year (sent in May, haven't heard back).
2)Want to join a 7-people Start Up company B as a financial analyst, which does not want to hire me as an "employee" but only as a "consultant" (i guess understandable for tax/risk reasons as the president of the firm is also hired as a consultant so ...).
3)How can I keep my H-1B with me? Can company B sponsor me as a consultant? or I need to have a third party consulting firm as a bridge? If so, any good agent or lawyers I can talk to?
Any advice highly appreciated.

It is hard to compare Canada vs India. India as other problems. If you want finance sector jobs then it is Bombay. It involves long travel
of 2 hours in locals each way. 4 hours travel...there is no personal time left after work. I personally cant take it...it might be different
for others. Power problems, traffic jam etc is there. It about what you consider quality of life, and that is different from person to person.
coming to US/Canada vs india, my friend who went back to india after 6 yrs here on h1b last april, says that he has adjusted back to his life there.......he has power cuts,limited water supply,traffic jams,long commute,sarkari issues like bills etc (hes in delhi)but he has accepted that as a part of life just like the first 25 yrs of his life when he was in india......so its very subjective and a matter of personal choice.......if u are ready to adapt,then u will be fine but if u always keep comparing ur lifestyle here v/s in india in terms of "quality of life" then u'll not b satisfied

Do you know if there are problems approving I-140 if company does layoffs at your site (even if I am not affected by the layoffs)? I know there could be problems for a pending labor, if there are layoffs while the labor is pending. How about I-140?

Your argument is that the country quotas help limit nepotism and discrimination based on national origin. However, this is already prohibited under DOL rules if you look at form ETA-750A. Therefore, if this is happening, it means there is a failure in the labor certification system to prevent this type of discrimination. Also, nepotism is not all bad as the Clintons and Bushes have been demonstrating :D.
The country quota owes its origin and sustenance to deep national insecurities around race. It will change eventually as the makeup of the nation changes over time. In the short term we will see movement as the UK bumps up against the 7% limit.
Honestly speaking; if the laws were followed the way they were meant to be; it would be extremely, extremely difficult to get h-1b; labor processing and 140's approved.

San Jose was a local CA event planned almost spontaneously. DC was an event planned months in advance. People were offered Free ride, Free plane fare, Free food (in Gurdwaras). Yet how many participated?
I have been refraining from posting on this point, as I wouldn't like to belittle the contributions of the strong team from California and the numbers they brought to the rally.
But let's face it. CA has more EB immigrants than the next three. Look at the recent 2006 Performance report from DoL (available at Mathew Oh website). CA had 21,000+ labor petitions compared to NY - 7,000, NJ - 7,000(?) , TX - 5000. As you can see CA scores more than the next three states put together.
If 40 people participate from NY, it's as good as 120 from Cal. Percentagewise it would be the same. If 40 peope walk in Michigan ( 2000 Labor petitions) statistically it would surpass CA, percentagewise.
It's a known thing that only 5%-10% of the population participates actively in the most successful movements be it American Revolution or struggle for Indian Independence. We haven't reached that critical mass yet ( at the regional level)
There is an enthusiasm right now. But how long before the fatigue sets in? Rallies need to be minimal, held with certain strategic target and should serve some specific purpose.
Weekend rallies attracting bigger crowds is a myth. Be prepared to listen to reasons like - Shucks I have to mow the lawn, take kids to Bharatanatyam dance classes, I have relatives over for lunch etc.
With that logic if we hold rallies over the LONG weekends, we should attract bigger crowd, since people have 2-3 days to relax afterwards. And since people already plan to visit Orlando, LA etc to visit Disneyland, Universal etc., if we can hold rallies there we should attract the highest possible crowd. Do you think my idea will work?
I agree with you 100%. Question is - who'll bell the cat? Who will take the lead and sacrifice their time, family life etc. to plan, organize and conduct these?
We need a fearless leader like Aman Kapoor, who can motivate and inspire people to participate, in every state. Where can we find them?
The answer is we all will have to bell the cat...and it will take more than a few attempts to do that.
IMHO, we should focus on what we can do rather than focusing on what some people could have done or what some one did to dampen the last attempt.
People will always find time for what is important to them; all we can do is try to make it more convenient and keep giving then enough opportunities.
We should have some sales/marketing people on this forum; they could have told us about how long it takes to convert a prospect to a customer.

I have really had good experiences when i renewed my passport, my wifes passport and also when i applied for my childrens PIO card. On each ocassion the documents arrived before time and the service at the SFO consulate was great when i called them with a concern. On all 4 ocassions i use the $20 option to get the document by Fedex. We spend thousands on the recurring nightmare at USCIS, $20 for peace of mind is not a big deal.
I have also observed that we tend to get overly agressive when we talk to indian govt officials here. I think we expect bad service and we mentally prepare ourselves to fight. I am not saying that all do this but some of my friends did concur with the thought. There are many geuine cases where there is a problem, as some desi govt officers are sticklers for making sure that forms are in 'order'.:D
Same with me (again SFO consulate in late 2004). No issue and everything happened smoothly. When I called to enquire on the status, they responded very professionally.
Again there are several factors to it. If the person recently came to USA, may be he will be much more polite and as days goes on, there true self start erupting OR its just they easily show their frustrations given there job security or could be we are loosing our respect with fellow indians as well recent times after all INS and federal governments are doing to aliens. Just my thoughts
I have also observed that we tend to get overly agressive when we talk to indian govt officials here. I think we expect bad service and we mentally prepare ourselves to fight. I am not saying that all do this but some of my friends did concur with the thought. Ok, As promised I am giving you an update I contacted my attorneys office yesterday the most senior attorney was out so I spoke to her assistant and according to him, If USCIS made a mistake then its their mistake not mine once the GC card comes enjoy it and if they realized they made a mistake 3 years from now or 5 years from now well by that time my PD would probably be current so whats the difference. He did recommend I wait longer than 5 years to apply for citizenship buts thats a long way ahead. It just might be my 4th of July gift. :) I will keep you all updated on any changes.

in addition to the house republican leadership (Hastert, Boehner) and a couple other influential ones on immigration such as rep Sensenbrenner.
Majority of these sponsoring congressmen have a green (anti-immigration) rating, some of them having a green-red (mixed) rating. However, they're mostly red (pro-immigration) when it comes to h1-b or related skilled worker bills (this even includes sensenbrenner's votes!)..
I did all this search out of boredom, but more importantly to assuage my sinking heart. So it looks like with the sponsorship of 10 pro-skilled immigration republicans, and at least not-against-skilled immigration republican leadership, this represents a good sample of republican votes for the passage.
Question remains how and when this bill will make it to the congressional agenda now that the summer is here already.
I keep my fingers crossed.

Did you get the email today that it was rejected? Also when did the package reach USCIS?
Updates:
I got an email from my law firm, that my packet was refused to be accepted by USCIS.
I received the email from my law firm (Monday night - July 2) that:
Please note however your case was sent to Nebraska last night and did arrive - we tried!
Which means mine was sent or reached NSC sunday night or must have been hand delievered early Mon morning. Don't know exactly what happened. I just trust them!!!!
I didn't bother to ask my law firm further details. I will ping them first thing monday morning and try to give any update I get. I hope they have some proof of the refusal!!!!!!!............
