Basically H1 is done for LCA which is to make sure that American worker is not is replaced for for the purpose of low wages. Such an attestation is not there in H4. They cannot deny the H4 unless documents are not clear. But H1 they can deny for other reasons. Basically to make H4 not able to work is also a kind of protection for american workers. But it is strange that l2 people can work but H4 cannot work. One cannot fight every law because more provision we ask more delay will be there. IF Skil bill is passed in current form most of people will get gc within 1 or 2 years.

Before others trying to guess which country I belong to, I want to admit that I am from India.
The point I am trying to make is about the categorization of the Employment Based immigration, which in itself is proof of the differences between categories (including the EB-5 or the Religious category) as identified and classified by the USCIS/DOS.
It is altogether a different matter as to what exactly a person classified in a particular category is doing in his/her job.
I would like to question what qualifications some of the CEOs in this country have, who draw undeserving remuneration from their companies. How many of the Bear Stearns employees are immigrants, both who will still be working and those who are already fired or are likely to be fired soon? How may of the those sub-prime loans are taken by illegal or legal immigrants?
Before starting to question me as to how my post relates to immigration, I request every body to critically think and then respond.

I did my masters here.I got my first job at Company A.They sponsored my h1b through masters quota and was working till feb 2007.Now I transferred my H1b to company B .Things are not working now with Company B.I have all the paystubs of company B

Company A didnt cancel or revoke my h1b.They would like to hire me again
Do I need a retransfer to company A - ?

People with EB3 applications should be allowed to port. But these should be EB3 applications which were genuinely applied and not substitute labor which opened during July 2007 fiasco.
Because a EB3 application with substitute labor in July 2007 has a priority date of 2002,2003,2004,2005 or even 2006. Where as a genuinely applied Eb2 prior to that, had the qualifications / job requirements before July 2007 and they are still waiting.
USCIS should realize their mistake in 2007, it encouraged a pay to play scheme, which is putting genuine people at great disadvantage.
Porting like any option was started with a good intention, but because of loop holes it has lost its meaning. There are people who landed in this country during the July 2007 fiasco, paid for the labor and have green cards in their hands now.
Or at least provide the same level of stringent requirements to port like (EB2-->EB1) . Technically a EB3 can port to EB1 also, but porting to EB2 is easier. That way Eb3's can consume Eb1 number and stop spill over to Eb2.
L1A is another one, where people qualify as global project managers with very minimal effort, could have less experience than a EB3 or in some cases they have reported to people in EB3 queue here from 2002 and are ahead of the EB3 within 6 months.

These 3 members are from a different pool. IV gave us phone numbers of Michigan members registered at the site. We have been calling and E-mailing these members about tommorrows meet.
The response received has been encouraging. Lot of members who couldn't participate in the first meet, did volunteer to participate in the future meets and other activities. We have created enough buzz about chapter and reached out to a wider audience ( some even unaware of the thread here). Three members (different from the three prospective attendees above) have joined our current google group.
We are also running a Newsletter today to registered IV Michigan members. We aren't leaving any stone unturned to get maximum possible members to attend.

Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.
When an eb2 complains about not having ead his concerns are valid and nothing else is more important on IV thean that
Eb2 are there in Eb2 for a reason and Eb3 are there in Eb3 for a reason.

I guess it depends... I would prefer to slog with weather in Canada for 3 years and get citizenship instead of stuggling for 4-5 years with desi consultanting company to get GC. My sixth year is about to start in december 2009 and employer has told that they will not sponsor GC. I am planning to take citizen ship from Canada and then move back to India. That way, anytime I want to come back to US/Canada doors will be open. I guess, there is no right or wrong answer, its a matter of choice.
Plus you children will also have option of deriving Candian citizenship from you but but...

The word on the street is that the Cantwell amendment is not a part of the list of amendments that are currently floating around in Senate offices. There are 20 of them.
Even Bernie Sanders has one more coming (Yes, it is related to H1B). But Cantwell amendment is not there in the list of 20.

How can anyone explain this now? Isn't it a money scheme? Is it reasonable to loose 3 months when you had already paid for it? There is always confusion in this whole GC affair. There seems no option than to live with it and move forward.
People have told me that they lose 1-3 months during ead renewal as the EAD is valid from the date of approval. But I do have seen 1-2 posts where they said new EAD starts from the expiry of current. That is why it is confusing. I think the former is more prevalent (losing 1-3 months of ead in overlap).

Wow, that sucks..
my app reached USCIS on July 2nd. I called up USCIS, the lady read the July Bulletin update word by word and then told me that my application will be rejected and the original documents will be sent back. She did not have an answer on how soon this will happen.

Yes, I used to say like this five years back when I had time and age in my hand. I assume you are in early or mid 20's. I will put it differently for you.
Assume there is a big pond which starts from 1 feet and gradually increases up to 100 feet. People with one year work experience steps 0.5 feet. There are life jackets(GC) floating around the pool and whoever is lucky is picking it up. There are guys like me who are already in 5th-6th feet deep without finding the lifejacket, but we are sure if we go further, may be 3-4 feet more we WILL find it. There are guys who are lucky to find a life jacket at 1,2,3 feet also and happily float to the shore passing us. The fifth feet guy is practically seeing how the 6th and 7th feet guys are struggling. May be they are seeing some one in 8 feet to 10 feet. Now a big Tsunami (retrogression) comes and drags all the jackets 20 feet down further. These guys are dejected and some of these guys even pull their spouse/kids in one hand when they float/swim.
Dont forget, it takes one year to step 0.5 feet. Every year the pond management drops a fixed number of jackets. These guys keeps their hope alive based on the above fact. But these guys are seeing some kids passing in motorboat(LC Substitution) paying that guy 10K and getting a life jacket. Hmm pain, but even if I had a chance I would have also done it.
Now comes your saying. When the deepest s...t guys talks about their fate down the line and how to take their family safe ashore, a guy at 0.5/1 feet shouts saying "Dont give up, it is like deciding to take a sanyas because you are tired of dealing with social issues".
If you are in 5+ feet, I take your statment. Otherwise, you will not understand what I am trying to say until you reach 5+ feet without finding a life jacket and also pulling your family in one hand and seeing your seniors struggling more in 8+ feet. :)

I am in my late 20's and am going to finish my 7th year next month...you decide how many feet of water I am in..:rolleyes: Meanwhile I totally understand your argument that the situation is the most frustrating for people who have been here the longest. I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)

What this mean is if you filed your 485 before July'30-2007 EAD will never be free for you...
