Hi folks!
My petiton was selected in the lottery but still when I check the status it shows "Case received and pending".
The petiton was applied when I was in India by employer A.But now I am in US with L1 visa from employer B.
These are my doubts:
1. How long will it take for my case to be approved?
2. So if I need to transfer my visa from L1 to H1B, do I need a personal apperance with the US counslate(outside US) and re-enter US?
3.Say my petition is approved and personal apperance is a must, then how long(maximum period) can I be in L1 before taking up the personal apperance?
Your help is much appriciated!

As the saying goes “the proof is in the pudding" anybody can give statements but it is the results that matter. What results has compete america achieved, they are just giving lip service. Contrast them with the health industry lobby which has achieved results year after year. Compete america ultimate goal is more h1b which they will achieve one way or the other.
Don’t get me wrong, I am not saying compete america is bad, I am just saying there focus is on H1b and not as much on EB relief. If they face a hypothetical situation where they can get either H1 or EB, they would gladly choose h1, that’s the bottom line. Its better to have somebody like compete america rather than nobody, but we need a corporate lobby whose main focus is eb relief.
And there is an important lesson to be learned from the health industry lobby. They just did not say they want CIR or skil and then went back when both cir and skil failed. They started chipping away at individual items like 50000 visas for Schedule A last year and 90000 this year from unused\recaptured visas. We should also be asking for our individual line item, 485 measure. This is how a war is won, one battle at a time. It is unrealistic to have an "all or nothing" attitude that people opposing 485 measure have. If the health industry lobby had such "all or nothing" attitude they would not have got the 50000 visas last year nor would they have been trying to get the 90000 this year. Hope we learn from them.
I am not sure about the statement "There is no corporate support for EB reform.....". Check this link http://www.competeamerica.org/. They seem to have the same agenda as ours (i.e., IV's). Is IV aware (or in collaboration) with them?

Actually some of concern of EB3 is valid.But their explanation cannot convince DOS or USCIS. According to DOS/CIS EB1 has more skills than EB2 and EB2 has more skills than EB3. That is not true in many cases. EB1 most cases are genuine except some cases in multi national managers. A manager in CTS could file in EB1 but at the same time similar manager in Intel cannot file in EB1. But only very few are in numbers because of restrictions like working in other country branch etc. So people do not bother about EB1 being current always.
Coming to EB2, the job requirement require Masters or 5 years experience. If the requirement is genuine then it is ok to give priority to EB2. But in reality(mainly consulting companies) the job requirement is decided mostly in Lawyers office or by candidate just because candidate has
master degree or 5 years experience. Though CIS scrutinise the EB2 applications still rejection rate is less. And also many persons trying to use 3 year degree and 2 year Master and apply for Eb2 by adding PG diploma etc.
So it appears that there is no difference in skills between EB2 and EB3. If CIS and companies follow strictly the law and good faith then number of candidates would have been less in EB2 and EB2 would have been current and remaining would have been transferred to EB3. But these reasons could not be given to DOS/CIS. According to DOS/CIS EB2 has more skills than EB3.

What I meant to say, you�ll succeed if you have the capability (with your professional knowledge, experience and skills) in your professional filed but definitely not with USCIS.
I can say, USCIS is a great leveler in this aspect. Everybody from PhD to Programmer is same in front of USCIS. All have to wait 10+ yrs with mental tension and anxiety, no matter what your caliber is and how successful you are in your profession.
Don�t get me wrong here. I also had to suffer for visa stamping, renewals, I-94 issues, PA etc in US Visa processing (nothing sever though). At the 5th yr of H1-B, I just decided.. to hell with that.....
I don't know about you guys, but, I would be heart patient with that kind of anxiety in another 5 yrs of GC process �. Really need a lion's heart to pursue US GC now days

On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.
As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.

I have long supported legislation to curb illegal immigration by increasing criminal penalties for immigrant smuggling and document fraud, eliminating the use of government documents that are easily forged, and doubling the number of border patrol guards. Better enforcement and tougher penalties for both undocumented immigrants and their lawbreaking employers are the way to fight unauthorized employment, and employment opportunities are what drive illegal immigration.
Unless we fix the North American Free Trade Agreement (NAFTA) and the Central American Free Trade Agreement (CAFTA) and enforce our own labor laws, we will continue to debate how high the fence should be and how many agents should guard our border � with no real solution in sight. In 1994, the U.S. signed NAFTA, which promised, among other things, to help create a thriving middle class in Mexico. At that time there were 3 million undocumented workers in the U.S.; today there are more than 11 million. In Mexico, 9 million more live in poverty than when NAFTA was enacted. NAFTA has failed the U.S. and Mexico. By creating an atmosphere where Mexican citizens feel they have no chance of a successful life in Mexico, these ill-conceived trade agreements increase the number of illegal immigrants coming into our country.
In addition to addressing the forces that are compelling illegal immigration, we must take action to bring illegal immigrants out of the shadows. While I do not support amnesty and have serious concerns about guest worker programs, I do believe our nation should consider establishing a process by which illegal immigrants can eventually earn citizenship. The solution to our immigration problem will not be a simple one, as many things in our country need to be fixed to stop illegal immigration. It is time to take a common sense approach to immigration reform.
The Senate most recently considered immigration when S.1639 was introduced in the 110th Congress. On June 28, 2007, the Senate rejected a cloture motion to proceed to final passage of S.1639 by a vote of 46 yeas to 53 nays. I was deeply concerned about the guest worker provisions in this bill, and voted against proceeding to a final vote. Should these issues come again before the Senate in the 111th Congress, I will be sure to keep your views in mind. Thank you again for contacting me.

Totally agree with you. I know guys who worked in production support and QA applied in EB2. At the same time people like me in positions such as Architect went with the ill-fated EB3. It is sad, but is the truth.

Problems will not go away. Such incidents may happen elsewhere or in the same place.
If Air France was genuine they should have made everyone stay in the same place or atleast talk to theie department of immigration and arrange a temporary supervised visa and take all people to the hotel.

sagar_nyc, agreed. EB3 is a joke and even worst I have become a joker in front of all my friends who applied in EB2 cheating the system. Funny is, experience wise, I am well ahead of all those making fun of me but...:-(

Frankly speaking, i am not a sufferer from BEC, but i want to know more about this mess.
Does the FIFO means, they process the applications in FIFO order, Does it mean that they approve also in the FIFO order? I think both processing and approving are different. Whoever got the case with less complications, will first get the approval and whose case got more complications, takes more time. Is it correct? I may be wrong. I think thats the reason why 2004 PDs may come out BEC fast sometimes as they put the case strongly and clearly.

My case was filed in 2002 under traditional labor certification. DOL never questioned anything or asked for any clarifications (so I assume there were no complications). The job was advertised in last April (it was a little newspaper advertisement with few lines and very generic job requirements). There were no resumes received. But still I have not received my labor approval. So what baffles me most is why has the DOL been not able to taken any decision on my case even after 5 years. One of my friends who applied in traditional labor two years after me has already received his LC. Let us say, for argument sake, the case was complicated. How complicated can it be to be delayed by several years, not months? We probably would get answers to these questions only if we drag the DOL to court and make them explain.
