    Could you please translate this into layman's English? What you appear to be saying is that speed (CIS efficiency) is more important than number (quotas), but your expample confirms that cases are stuck because of number unavailability (quotas), not because of CIS inefficiency. You got your own green card in three months, did not you? That tells me that CIS darn well capable of processing applications in a timely manner.

    Like I said, its a combination of the 2 main things, the efficiency of processing and the quota limits. Changing either 1 without the other other probably won't get us far.

    Yes, USCIS IS capable of processing quickly (for example, my own case - but I'd say I was very VERY lucky, rather than an indication of system wide improvements). Remember, my GC was approved whilst my PD was not current, and I am still baffled why this happened. Having talked to many people about it, there is a strong suspicion of "squeaky wheel" helping.

    What I was trying to say was - the perceived improvement in speed in the last quota 1/4 of this year (May- Sept) was NOT because USCIS suddenly streamlined and improved their processing speed. It was because there was a backlog of approved applications just waiting for PDs to move so that visa numbers can be assigned.

    They have to abolish the H1B programme completely since they can no longer prevent its abuse. They need to have a new process in place in which scrutiny occurs for each application of a foreign worker!

    If you are so sure about this, why don't you consider spending your own money to get initial professional consultation. May be that will enlighten you. Many laws don't apply to Immigration Laws, so what you have written has no meaning.

    Answer just this question - Can an H1-B worker claim that he/she should be sponsored for green card just because his/her coworker has been sponsored? Just think about the answer and may be you will see the reasoning.

    People here are mixing different laws without knowing each law's applicability limitations.

    Coming back to the discussion about EB3->EB2:

    1. For all those who have already initiated the process and are aware of the delays in PERM (about 8 mos) and 140 nowadays (about 10 mos), the cost involved (close to $9k) and without a guarantee of a successful interfiling (a lot of people on this forum earlier had narrated instances of failures), what was your motivation to continue??

    2. Has anyone started this process with their EB3 140 still pending?

    An infopass IIO has no way to find out from the CLAIMS3 system whether the AC21 actually reached your file. I have a hunch that since they included your new G-28 your AC21 docs are also included in your file.

    Do not worry... just maybe a few anxious days and you will be all set:)

    I got some more information from InfoPass

    They have received G-28 and i saw my present attorney address which is good. Because my present attorney will receive the denial notice.

    2nd, The AC21 letter never reached them..... Somehow blackhole swallowed it....

    I think you can transfer to the company's new address as a new job offer after 180 days of I485 application. You can consider AC21 for this new job. In this case you have to stay atleast 180 days in your current location after 485 application. If you cannot stay in this location for 180 days then you can transfer to the new location and apply labor and then 140 premium processing. If it get approved within your current H1 duration then you can transfer your old PD from previous application to your new application. In this case you need to get H1 extension immidiately so that you would be in valid status all the time.

    My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?

    - My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?

    - Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

    some of you asked about repercussions of this sudden forward movement. i am not a lawyer or anything but I think the processing time for employment based 485 in Nebraska Center will move back from Aug 13, 2006 (

    ).

    I dunno... may be by a year I guess (again total speculation - I am not a lawyer or an USCIS expert).

    also according to (http://www..com/usa-immigration-trackers/i485-graph) current processing times by recent approval dates seem to be between 250 to 350 days range (disclaimer: there are other ways to analyze this).

    Allow me to emphasize a different section of the text:

    The AC21 removed the per-country limit in any calendar quarter in which overall applicant demand for Employment-based visa numbers is less than the total of such numbers available.

    The way I read this is that this particular AC21 rule only applies if there are no cut-off dates in any category (for that calendar quarter). This is clearly not the case in this bulletin, where the cut-off date for EB3 is set to July '05. Hence, the new interpretation seems different.


    During FY due to anticipated heavy demand, the AC21 provisions are not expected to apply ...] This will mean an Employment per-country limit for FY-2006 of approximately 10,650.

    To illustrate the effect of the reduced per-county limitation during FY-2006 on the oversubscribed countries, it should be noted that during FY-2005 India used approximately 47,175 Employment numbers.

    Maybe I'm misreading above statement, but it sounds to me that because of higher demand (of ROW), AC21 wouldn't apply anymore, and instead of 47k in '05, India had only received 10k in '06.

    Note that I think the immigration system is broken and needs to be fixed. By changing their interpretation, they are only taking away visas from one group and give it to another group. I can certainly see why people who are affected by this would be biased. No harm intended.

    I think I know how this works. They would outsource this program to some govt contractor (or ask the govt contractor who is working on their data ) to produce that report which costs (<10$ worth of time/effort, if they have all the data).

    If all they want is money ..so be it. I am ready to pony up $50 for this,if we all approach together. But as someone suggested country of chargability is a must.

    But I agree with Tito to some extent. Especially, if the degree is from even a slightly lower ranked school like Arizona or Northwestern, the returns are not there, and there is a great deal of evidence in that direction.
    But it's still just my 2 cents.

    Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.


    Ok, firstly, if you are really honest about your feelings, no one is really happy for another unless what the other has done is useful to you. You can wax your eloquence with claims to contrary, but you know it is true. So stop this pretensions.


    Ok, you want a constructive suggestion? Rat on everyone who is doing fake jobs, is a body-shopee, bought his GC etc. That should get rid of at least 20-30% (conservative numbers). How many will support it? I guess not many.

    How about asking USCIS to make the priority date of the substituted applications to be the day 140 is filed? Any takers there? I guess not.

    And then people have the gall to tell us to be happy for Eb2ers, and that we are jealous.


    PS: I realize that substitution is no longer possible, I mean to ask USCIS to retroactively apply the priority dates for such cases.
