My priority date is Jan 2006 in EB3 and I wanted to understand what happens after you file I-485. Is is all first come first after that or they will process 485based on priority date. What if I filed my 485 on july 1 and another person with an earlier priority date filed it after 6 months considering the priority dates are still current till then. Will mine be processed before the other guy.
Also, I was going to take a promotion in my company and file a new application in EB2 but with all dates being current now I am confused. I will still apply for 485 in Eb3 and get the benefits for EAD and AP but I am sure the final approval and getting of green card is going to take 5-6 years for jan 2006 eb3 dates.
My questions
Can I still change to Eb2 after filing a 485 in EB3?
Can I port the priority date from EB3 to Eb2 after eb3 140 is approved?
Please help

I had a chance to get to know Genia Brin, Google founder Sergey Brin's mom, when we jointly served on the board of HIAS. She's an impressive woman who could sit back and relax, but instead she goes to work everyday as a NASA scientist and works on climate and forecasting projects for our nation's space agency. I got laid off from Company A in Jan.2009 but I filed transfer for my H1-B to Company B based on receipt notice which I have for Company A. but Just now I came to know from USCIS that Transfer which I filed for Company A in Oct.2008 has RFE and Company A denied to answer RFE cos I am no longer their employee.
Question:
1. Can I get a receipt notice for Company B ?
2. Is there really an Issue for my Transfer to company B due to RFE in previous filing?

I need your suggestions on my situation and below is the same.
1. Priority date (04Oct2006) is current in June bulletin
2. Applied labor & I40 with previous employer.
3. Applied I485 in July 2007 ( applied I 485 before marriage) with previous employer
4. Joined other employer on Sep 2009
5. Not applied AC21 portability to new employer.
Now my priority date is going to be current as of June 1st, so need to file I-485 for my wife. Based on my situation could you please suggest the best approach to apply dependent's I485. i.e Apply dependent I485 from previous employer or through my new employer asking for AC21 along with employment verification letter).
Appreciate your help in advance.

Hello all, with the August bulletin showing June 06 cut-off dates, I have the following questions for which I seek input form IV members.
1. Is it possible to apply for the GC, the second time, if one cancels his GC "without prejudice"?
2. If yes, is it possible to use the priority date of the canceled GC in the second GC application?
3. What are the points one should be aware in canceling GC "without prejudice"?

I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.
How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

Hi,
H1 Company is based in Phoenix with another office in delaware.I have gievn my address from NewHampshire on my LCA and NJ on my I 140 application.I work for a client in Newyork.I have given my address in New hampshire as I was not sure that my project will be for a longterm and gave my cousins address in New Hampshire for LCA.
I got an RFE asking why I have different addresses on my LCA and I140 while my company is based out of Arizona and Delaware.Please suggest how I should be answering this.

I do not think so. I believe these are two separate issues and should not have any effect on the chances of your frnd securing visa.

Is it true that if you are on H4 visa and you are using Ead ...and your I-485 is denied...this invalidates your H4 status and you have to leave U.S?
I know that this situation applies only for H1B holder, not H4, the dependent.
If I'm out of H4 status...what are my options? How can I go back to H4 status?
Please advice....this is vey important for me.

George W. Bush has been the most accommodating of presidents. He has rarely used his veto pen to kill legislation. Until now.
Last week, Bush vetoed a bill that would have expanded federally funded embryonic stem-cell research. He said scientific advances allow researchers to pursue lifesaving work without destroying human embryos. It was his third veto ever.
But there will soon be more. Lots more, and almost every one of them will have an impact on the markets and business growth.
Bush has attacked the opposition party for "excessive spending" and has vowed to veto many of Congress's 12 appropriations bills, which are on track to exceed his wishes by $23 billion in the next fiscal year.
In response, some Democrats have said they can play that game, too. A faction thinks the last thing they should do is let pass almost any legislative initiative Bush and his party can claim credit for, including the immigration and energy bills Congress is working on.
These confrontations are shortsighted no matter who's to blame. A budget impasse would depress markets and weaken the dollar. Failure of the immigration bill would threaten businesses that hire illegal immigrants with increased sanctions or compel them to hire fewer people, either of which would lead to higher prices. And energy shortages could easily become chronic unless more is done to reduce our reliance on high-price oil.
Shallow political finger-pointing is not an adequate response.
