Hello!
I am pursuing part-time MBA while working for a company which has sponsored my GC. I am on EAD based on EB3 filing with PD of March 2005.
I plan to do a summer internship (10-12 weeks) at another company and need to understand the risks. This internship would be 40-hr/week so I will have to either
* quit my job and then search for another full-time job after internship is over, or
* take a Leave of Absence (LoA) for 3 months and come back to my current job
The first option is obviously very risky so I am inclined towards the second option though I don't know if my employer will grant me LoA. Could you please advice me whether doing an internship will be an issue later when my PD becomes current.

Keeping in view the current and anticipated situation in Oct 2007, would priority date transfer help me at all or I will have to face same processing times?
My assumption is that visa numbers will be unavailable from Aug 17th to Oct '07 and when the new visa number become available, the dates will retrogress to 2003 or 2004 ... who knows. So using old PD may earn me advantage in that case.

My daughter has joined in a medical program in India and she has to return to US after 4 years to continue her studies. Her 485 is in process and she has stamped H4 upto 2012 ( 3 years from now). I am trying to find out the best strategy to get her here after 4 years if we dont get GC prior to H4 stamping expiry.
Should I continue to apply her EAD and Advance parole whenever she visits US (She will come to US atleast once every year)? Or Can I apply for her EAD and Parole just before the expiry of her h4 stamp (That is after 3 years)? Please advise.

has there ever been any regulation issued by the USCIS for the AC21 law? i know about the yates memo in 2005. however, even that memo says that there will be a regulation coming in... so was that ever published? i just want to find out once and FOR ALL whether uscis will allow me to do self-employment in a same or similar job and how prepared should i be for zealous immigration officers sending me way-too-detailed RFEs for stuff related to self employment... i contacted a few lawyers, the only one who was encouraging enough for my taste said that she/he will charge me my arm, leg and possibly an eye or ear... so whats out there already?

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

A Masters degree or Bachelors + 5 years of progressive experience is the minimum requirement for EB2. In addition, your employer must justify in the future job description, that they require to hire a qualified person like you. Yes, it is the lawyer who decides on the employment category.

I have one question: My I-485 applcation (employment based) was rejected due to I-130 attachment in error.
If USCIS reject my entire package of I-485 because I have attached I-130 application. What are my options? Is there any law that USCIS can only reject I-130 and accept I-485 appplications (myself and for my wife)? I have seperate fee checks for all the applications.
Please help me....
