The Chief of Staff of U.S. Citizenship and Immigration Service’s (USCIS) Fraud Detection and National Security (FDNS) office explained three different types of site visits being conducted by USCIS.
Risk Assessment Program Fraud Study: program is part of a study to help design profiles of potential fraud. Family-based petitions or employment-based petitions once approved are randomly selected.
Targeted Site Visits: this visit is to ask questions when fraud is suspected. Advance notice of visit is given.
Administrative Site Visits: for religious worker and H-1B programs. Specific questions generally regarding the beneficiary’s job duties as stated in the petition and whether the beneficiary is receiving the wage as stated on the petition.

FOlks,
I am tired of this GC process like u all are. the following is my situation.
Currently on H1B and 140 cleared with company B, no 485 applied missed the boat during the VISA bulletin fiasco(USCIS money making scam)
i have a future GC with COMPANY A, 485 applied, i have EAD/AP also.
i am tired of my current job, too much exploitation, i want to change, so my question is can i just take some other permanent employment using this EAD/AP
My question is as this future GC with COMPANY A and i have never worked for this company A. can i do a AC21 and move on ?
does AC21 apply future GC. ?
Appreciate any thoughts in this matter

I have question , How long it will take after submitting the evidence . I have received RFE on Jan 15 and submitted 03/25/2008 and I have seen LUD 03/27/2008 .
How long they will take time to decide the case?

News letter to members is a good first step...I would suggest a news letter every week with just fund rising and also increasing memebership in mind .The wording should be tuned towards rising $$.You can put on big bold wordings at the top % met versus our target..
Keep rowing guys we are almost there!!
Also..somebody with good writing skills write 1/2 page letter..about 8 different formats and wordings...so we can print them out and gives us a list of senators address...each member can spend 37 cents...even better fedex these to senators asking for support on the Skil Bill...

How can we help ourselves to get 2 year AP ? IV admins, can you kindly share with us any info regarding this ?
I know at this moment everyone is looking at the stimulus plan and economy, but , in the mean time we can prepare ourselves with some plan of action...
May be we should push for 3 year EAD/AP . Our argument should be, if we are 3 or more years away ( like EB3 India is currently 2001 or something ), we should get 3 year EAD/AP
Not meant to talk only for EB3 community, but in general as well.
Any thoughts IVians ?

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. It is advisable to file change of status to h4 while in USA, no need to go back to India. After you get your h4 approved then you can go for stamping...
That is good approach, if
1. one is maintaining status at the time of H-4 Change of status application
AND
2. Person is not traveling out of USA in short term future

I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.
My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.

Hello Folks,
My H1b is 2 and half years old. I transferred it once, i.e in 2007
My brother has got GC a year ago and started his own company. I am planning to transfer it to him.
I have these following questions.
1. What is the risk on transferring my H1 to a new/small company in this recession period, and the employee strength is just one (my brother).
2. Is it ok to transfer more than one time in short period(i.e in 2 years span)?
3. Also, is it acceptable to stay outside US for couple of months on H1 status with out payroll? Will that be a problem at POE when i return to US?
4) Right now i am out of the project (on bench), so will that be any risk of my H1 transfer getting denied ?

hi, my wife's ead expired in 2008 and did not get it renewed as she is a housewife and is not going to work. we got her ap renewed thouht and travelled out of usa. my question is when we re-enter usa will the port of entry officials ask for a valid ead for my wife for allowing re-entry. or just valid ap is enough for re-entry.

Today , an officer from Homeland Security visited my office.
The guy showed his Identity Card and was looking for me and the my boss (who signed the Visa Papers). He took me privately in a conference room and asked me questions like my pay, my duties, who paid for H-1 renewal etc.
Then he went to our HR dept and asked a few questions regarding my employment history. He asked me if you are treated well in this company. ( Note: Mine is not a consultant company) Anyways the guy was very polite and he told me its just a formality from homeland security
also he took picture of my desk
On searching more on this I came across this site
