My sister, as part of submitting documents for her fiance visa application, recently got a birth certificate. However, it doesn't have her name on it. Odd as it sounds, the municipality says that this is common practice. It just has the name of the parents.

I am trying to get an infopass to check my I-485 status
1. After selecting "you need information or other services" in the infopass process, The infopass is not showing me any appointment dates, instead it is showing "At this time, there are no information appointments available for the office in your area. Please try back again later."
I have done infopass before 6 months ago, and it showed me the date to select but now it is now doing that. just the message "At this time, there are no information appointments available for the office in your area. Please try back again later."
Does anyone faced the same issue and help me to get an infopass!

Can you get AP when you are out of status anytime during your stay in USA, if you get AP can you travel outside USA and enter back using it.

I changed my employer 3 months back and didn't expect the dates to get current so soon. My labor with the new employer has just been filed. However, my previous employer told me that if I want to continue with my gc process with them, I need to be their employee again.
Does it make sense for me to do this ? My 485 will not get filed until 10 days from now because I have yet to start with the paperwork.
Will the dates retrogress by then? Please advise me folks.

Hi All,
My wife is on H1 since Oct 2009. No paystubs. Now she want to come back on H4. Her H4 stamping expired. I have my H1 renewed in Oct 2009 and need stamping.
What are the best and low risk options to convert to H4 status. Please advice

She most likely is out-of-status for a long time (more than 6 months). Also she started/would start accruing illegal/unlawful presence from the day her I-94 expired/expires. Talk to a lawyer before doing anything.

You should be able to contiue your GC without interruption even if you did not work for the sponsoring employer. but just make sure you are employed with the sponsoring employer before filing for I-485.
You may need a new H1 to go back to the previous employer. But GC should not be affected.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. My background:
1. Got Ph.D three years ago
2. worked in a hospital as a PI and postdoc training for three years
3. worked as research associate at University of Houston last year
4. working as research assistant professor(Faculty) at UH
5. Four foreign grants including national grant
6. several awards including the First Prize awards in foreign provincial health field
7. Published more than 20 papers, only two are SCI (one is PNAS published this year without citation so far), others are foreign language papers have more than 40 citations.
Now I am preparing files and will apply as EB-1b.
can you tell me the best points to claim?

* My current L1-B expires in June
* I am getting married in April - So I am traveling to India in April, returning in May.
* My company is planning to apply for my L1-B extension.
* My future wife will try to get her L2 in April, after our marriage, planning to come with me in May.
I hear that i am not supposed to be traveling while the L1-B is being extended. I also hear that the consulate may reject L2 if the L1 is about to expire.
1. Are these above rumors true ?
2. Is there a problem if my company applies for my L1-B extension and I travel to India at the same time ?

One of the RFE we got has the following two questions.

Company A filed my I-140 and it got approved, however I have not been provided with copy of the approval notice. I don't have the receipt number either. In this case, is it possible to obtain the copy of I-140 thru FOIA (Freedom of Information Act)?

In 2002, I left my employer(A) and joined another company(B). New employer applied for my h1b and in 3 months we got an RFE. Coincidentally, I did not like that job and just left that employer(B) to join the previous employer(A).Never tried to get the h1b reciept from. Now that company is folded and there is no information about that company(B). Later that year, company B gave me a W2 for 3 months pay which I had to file later that year.
While applying for 485 in june 2007, in mad rush I had to fill up G-325 form and I did not write anything about working for company(B) for 3 months. Rather I mentioned that I worked for Company A thru 2002.

I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

I was on H1B until Feb 2009 and I applied for COS to H4 in Feb 2009. USCIS has received my COS application, and it is still pending with USCIS for 2 months now.
1. Can a new employer apply for a new cap-exempt H1B for me (technically a transfer, as I was on H1B for 2 years before)?
2. In that case, do I need to submit paystubs and W2s from when I last held H1B status?

When preparing docs to provide response for 221g form, I have filled DS-156 form at http://https://evisaforms.state.gov/ds156.asp. On click of Continue, it generated a PDF with randon bar code. Printed that online. And sent to docs to VFS Hyderabad officer.
I was told that bar code is wrong, I should fill up another DS-156 form. Are they looking for DS-156 submitted at the time of interview that has HDFC receipt number as bar code.
Please let me know if you have faced this problem earlier.
They have retained my wife passport asked to produce to copy of current visa of husband. Can I reply to this online.
