(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....

Documents requested for RFE (also suggested by lawyer):
- Client Letter, role/responsibilities, duties, technologies used, company profile etc.
This letter also clearly stated all entities involved and their relationships with each other.
- Purchase Order and Other contract related stuff (all possible). Everyone co-operated.
- Badge (main bulding, her office), timesheets
- photos (cubicle/office building,company logo etc), login screen, machine etc, client phone directory
- copies of recent pay stub and offer letter, job duties
Thanks to everyone who contribute on this forum. It helped us a lot. This is for my wife.

Hello,
My firm is about to start greencard processcing for me and this is the first time that they are undergoing this process. They are searching for letter templates which decribes the employee eligibility and responsibilies in the firm and why they want to recommend greencard for this perticular employee. While taking a VISA appointment , there is a question which says "Are you applying for same visa class that expired in the last 12 months?"
Here are my doubts
1. I had a H1 B VISA which expired in May 2007 processed by my previous employer. As I am applying for the same VISA class , but though a differnt employer, should the answer be 'YES'?

I came to know from one of my friends that we do not receive our EAD after 90 days of receiving the receipt no

I recently received my FP appointment date, but I have to be on a conference the previous day. If everything goes well, I can arrive to my appointment without any problem.
But if my flight is delayed or cancelled I might risk being late to the appointment. My appointment is 10:00 am in the morning, are they very strict about the timing for FP appointment, or can we go a little late if we were delayed? Can you please share your experience?
Also, How early should we call in to postpone the appointment?

Hi, I have approved H1b through company "NewCompany" but my GC sponsoring company "GCcompany" is planning to cancel my APPROVED 140. Again, I know USCIS will do inted to deny and Yes, I have filed for 485 + it's been 180+ days but I guess the most important question of all is:-
"Will this affect my H1B status?' Since the approval for new 3 year (extension) was based on my 140 and now this thing is under jeopardy. If I use EAD, my wife will no longer be H4 and thats a different problem- Gosh when is thind going to end?"

hello! i overstayed my visa by several years, left , and was able to get a new tourist visa and enter the u.s.
after leaving the u.s, on return,i was denied enterance, removed and banned for 5 years. my boyfriend lives in u.s, he's a citizen. is a fiance visa helpful to allow me in until we get married? is there even a chance? or do we need to marry outside of the u.s in this case? thank you!

While President Bush threatens to use his veto pen to stop some bills and Senate Republicans block other measures from even reaching his desk, no force in Washington can halt the Democrats' investigative juggernaut from uncovering the secrets inside this administration.
For the first six years of the Bush administration, these aides were allowed free rein to carry out whatever policy or political assignments they wished -- or supposed that the president wanted done. A Congress under firm Republican control was somnolent when it came to oversight of the executive branch. No Republican committee chairman wanted to turn over rocks in a Republican administration.
You have to feel a twinge of sympathy now for the Bush appointees who suddenly find unsympathetic Democratic chairmen such as Henry Waxman, John Conyers, Patrick Leahy and Carl Levin investigating their cases. Even if those appointees are scrupulously careful about their actions now, who knows what subpoenaed memos and e-mails in their files will reveal about the past?
They will pay the price for the temporary breakdown in the system of checks and balances that occurred between 2001 and this year -- when the Republican Congress forgot its responsibility to hold the executive branch accountable.
It was a fundamental dereliction of duty by Congress, and it probably did more to encourage bad decisions and harmful actions by executive-branch political appointees than the much-touted lobbying influence. In reality, many Republican members of Congress did not mind what was happening because they were able to get favors done in that permissive climate. Now, the Democratic investigators will publicize instances of influence by members of Congress, and the political fallout will not stop with New Mexico's Pete Domenici and Heather Wilson.
Democrats find it easier to investigate than to legislate. With their major initiatives, from a minimum-wage boost to a shutdown of the Iraq war, stymied by Republican opposition, the Democrats are understandably making "accountability" their new goal -- meaning more and more investigations.
Fulfilling that promise, later in the week the House passed a series of bills that stripped some of the secrecy from executive branch documents and decisions.
Accountability is certainly important, but Democrats must know that people were really voting for action on Iraq, health care, immigration, energy and a few other problems. Investigations are useful, but only legislation on big issues changes lives.
